Delegated Act on a methodology for renewable fuels of non-biological origin

Delegated Regulation (EU) 2023/1184 defines the methodology for determining when hydrogen-based fuels (RFNBOs) qualify as renewable under the Renewable Energy Directive (RED II/RED III). It establishes conditions for additionality, temporal and geographical correlation, and lifecycle emissions. it operationalises key provisions of Article 27(3) of RED II and RED III. Enter into force on 1 January 2024. Transitional rules apply until 31 December 2029 (e.g. relaxed correlation)

It sets out rules on:

  • Electricity sourcing requirements for hydrogen electrolysers
  • Additionality: ensuring renewable electricity is newly built and not diverted from other uses
  • Temporal correlation: alignment between renewable electricity production and hydrogen generation
  • Geographical correlation: distance between electrolyser and renewable energy production
  • Emissions accounting for the purpose of GHG savings and compliance with RED targets

It defines whether hydrogen and its derivatives qualify as renewable, influencing eligibility for support schemes, tradability, and market access. Compliance with correlation and additionality rules affects the design and price of long-term supply contracts. It also constrains sourcing strategies for RFNBO traders and aggregators. Market platforms trading renewable gases must verify that products meet RED-based criteria for certification and traceability.
